The U.S. government is taking another step toward allowing Americans to include Bitcoin and other digital assets in their retirement savings. A recent review by the White House has cleared the way for a proposal that would make cryptocurrencies available inside 401(k) plans, potentially expanding investment options for millions of workers.
The proposal, originally put forward by the Department of Labor, is now closer to a final decision. If approved, retirement accounts could begin allocating funds to Bitcoin and other alternative assets, something that has long been debated due to risk and regulatory concerns.
Kelsey Mayo, ARA’s Chief of Retirement Policy and Regulatory Affairs, stated,
“The Office and Management and Budget’s return of the proposed rule to DOL is an important procedural step in the rulemaking process. It means the proposal has cleared interagency review and is now ready for the DOL to move forward with publication.”
This development follows a broader push from policymakers to expand investment choices in retirement plans. An executive order issued in August 2025 called on regulators to reassess restrictions around alternative investments, including digital assets. The directive encouraged agencies to clarify rules and make it easier for retirement plans to consider assets beyond traditional stocks and bonds.
Officials argue that strict regulations have limited diversification for retirement savers, leaving many unable to access opportunities commonly used by institutional investors. The initiative aims to remove some of those barriers while still maintaining oversight.
At the state level, momentum is also building. Several states have started exploring ways to include Bitcoin in retirement offerings, with Indiana becoming the first to formally legalize crypto-based retirement funds earlier this year. If federal regulators move forward, more states and plan providers may follow, potentially bringing Bitcoin into one of the largest retirement markets in the world.
