The Netherlands has unveiled a proposed crypto tax law to boost transparency by requiring crypto service providers, like exchanges, to report detailed user data to tax authorities. Open for public comment from October 24 to November 21, 2024, the proposal aligns with the EU’s DAC8 directive, aiming to standardize crypto tax reporting across Europe.

A New Framework for Cross-Border Data Sharing

Set to take effect in 2026, the law mandates that crypto service providers collect information on user identities and transaction histories, facilitating cross-border data sharing among EU tax authorities to combat tax evasion. This initiative offers crypto businesses a transition period to adapt their systems and ensures crypto transactions are fully traceable by tax authorities, reinforcing the EU’s efforts to regulate digital assets.

Enhanced Oversight for Dutch Crypto Holders

While Dutch crypto holders already disclose their assets on tax returns, this new measure will give tax authorities enhanced tools to verify these claims, contributing to a more transparent and organized crypto environment.

Global Alignment in Crypto Tax Transparency

This aligns with the OECD’s Global Crypto-Asset Reporting Framework (CARF), allowing cross-border data exchange with countries like the U.S., Canada, and the U.K. Meanwhile, other EU countries are ramping up crypto tax measures, with Italy proposing an increase in crypto capital gains tax to 42%, encouraging investors to consider more favorable jurisdictions.
